TERMS AND CONDITIONS OF THE YUTRA.EU ONLINE STORE

I. GENERAL INFORMATION

  1. What do these Terms and Conditions specify?

These Terms and Conditions specify the rules for providing services electronically and the sale of goods and services by Salag Sp. z o.o. through the Online Store available at: https://www.yutra.eu/.

These Terms and Conditions are addressed to both Consumers and non-Consumer Customers who use the Online Store to access electronically provided services and enter into Sales Agreements.

Any provisions of these Terms and Conditions and agreements related to the operation of the Online Store that are less favorable to the Consumer than the provisions resulting from Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights are invalid, and the provisions of the consumer rights directive shall apply instead. In the event of any unintended inconsistency between the provisions of these Terms and Conditions and the above regulations, the provisions of the aforementioned directive and relevant national consumer protection laws shall take precedence.

  1. Terms used in these Terms and Conditions:

a) Customer – a natural person, legal entity, or organizational unit without legal personality that has legal capacity granted by law, who uses the services provided electronically or has entered into or intends to enter into a Sales Agreement with Salag.

b) Consumer – a natural person entering into a legal transaction with Salag that is not directly related to their business or professional activity. The provisions concerning Consumers also apply to natural persons entering into an agreement directly related to their business activity when the content of this agreement indicates that it does not have a professional nature for that person.

c) Terms and Conditions – these terms and conditions regulating the rules for providing services electronically and the sale of goods and services through the Online Store.

d) Online Store – the store available at: https://www.yutra.eu/.

e) Salag – Salag Sp. z o.o. with its registered office in Suwałki, at ul. Szafirowa 5, 16-400 Suwałki, Poland, registered in the Register of Entrepreneurs of the National Court Register by the District Court in Białystok, XII Commercial Division under number 0000992485, NIP: 8441941084, REGON 790744763, share capital: EUR 213,000, which provides services electronically and sells goods or services through the Online Store.

  1. Availability of Terms and Conditions and their acceptance

The Terms and Conditions are available free of charge at https://yutra.eu/terms. Customers can view the Terms and Conditions at any time free of charge, download them from the website, or print them.

Acceptance of the Terms and Conditions is voluntary but necessary to use the services provided electronically and to purchase goods and services through the Online Store.

II. ELECTRONIC SERVICES PROVIDED BY THE ONLINE STORE

III. SALES CONDITIONS

  1. Order Placement and Confirmation

Orders can be placed through the Online Store 24/7. Orders placed on weekends and holidays will be processed starting from the next business day.

All prices in the Online Store are given in Euro (EUR) and include all applicable taxes.

Payment Methods: The yutra.eu website uses the "iMoje" payment gateway operated by ING Bank Śląski, which acts as an intermediary in transactions between the merchant and the customer. Payment can be made using major credit and debit cards (Visa, Mastercard) through the secure iMoje payment system.

Delivery is available throughout the European Union. Delivery times and costs vary by country and will be displayed during the checkout process. Standard delivery time is 3-14 business days, depending on the destination country.

IV. RETURNS AND WITHDRAWAL

Consumers have the right to withdraw from the contract within 14 days without giving any reason, in accordance with Directive 2011/83/EU. The withdrawal period will expire after 14 days from the day on which the Consumer acquires physical possession of the goods.

V. PAYMENT METHODS AND TERMS

  1. Available Payment Methods

The Online Store accepts payments through the iMoje payment gateway operated by ING Bank Śląski. This secure payment system allows customers to pay using:

  • Credit cards (Visa, Mastercard)
  • Debit cards

All transactions are processed securely with 3D-Secure protection and SSL encryption.

If the Online Store does not receive the electronic payment, Salag will contact the Customer with a payment reminder via email. If payment is not made within 7 days of placing the order, the order will be cancelled.

  1. Proof of Purchase

Salag will provide the Customer with proof of purchase (invoice) electronically to the email address provided during order placement. If requested, a paper invoice can be included with the shipment.

VI. DELIVERY AND ORDER FULFILLMENT

  1. Delivery Area

Delivery is available throughout the European Union. Each delivery destination may have specific delivery times and costs, which will be clearly displayed during the checkout process.

Delivery costs are calculated based on:

  • Destination country
  • Selected delivery method
  • Order weight and dimensions

Delivery costs will be clearly displayed before order confirmation. Salag may offer free delivery for orders above certain values, which may vary by destination country.

Standard delivery times:

  • Germany, Austria, Czech Republic: 3-5 business days
  • Other EU countries: 5-14 business days

The delivery time starts from:

  1. The confirmation of payment receipt - for card payments
  2. Order confirmation - for other payment methods
  1. Customer Rights and Obligations Regarding Delivery

The Customer confirms receipt of the shipment by signature or other documentary form that enables identification of the recipient.

The Customer has the right and obligation to:

  1. Receive the order unless the package shows signs of damage
  2. Check the shipment for content, completeness, and compliance with the order
  3. Pay for the delivered goods if payment hasn't been made in advance

If the package shows visible signs of damage, the Customer is advised not to accept the delivery. In such cases, please note the damage on the delivery note and inform Salag immediately via the complaint form available at: https://yutra.eu/returns_and_complaints

VII. COMPLAINTS

  1. Filing a Complaint

All complaints, including those regarding goods or services, should include:

  • Order number
  • Customer identification data
  • Product name, type, or description of non-compliance
  • Date of discovery of non-compliance or damage
  • Description of non-compliance or damage
  • Photos showing the defect, non-compliance, or damage
  • Damage protocol prepared with the Delivery Person, if the complaint is filed upon delivery
  • Proof of purchase

  1. Response Time

Salag will respond to Consumer complaints promptly, no later than 14 calendar days from receipt.

VIII. RIGHT OF WITHDRAWAL

  1. Withdrawal Period

Consumers have the right to withdraw from the contract without giving any reason within 14 days. This period begins from the day of taking possession of the goods.

To exercise the right of withdrawal, the Consumer must inform Salag of their decision through an unequivocal statement (e.g., a letter sent by post or email).

  1. Effects of Withdrawal

If the Consumer withdraws from the contract, Salag will reimburse all payments received from the Consumer, including delivery costs (except for additional costs resulting from the Consumer's choice of a delivery method other than the least expensive standard delivery method offered by Salag), without undue delay and no later than 14 days from the day of receiving the Consumer's withdrawal notice.

  1. Return Shipping Costs

The Consumer shall bear the direct cost of returning the goods. For goods that cannot be normally returned by post due to their nature (weight and dimensions), the return costs will be higher than regular postal charges.

IX. PERSONAL DATA PROTECTION

Personal data processing in connection with the Online Store's operation is carried out by Salag. Personal data is processed for purposes, within the scope, and based on the principles indicated in the Privacy Policy.

X. DISPUTE RESOLUTION

  1. Legal Basis and Jurisdiction

All contracts concluded by Salag in connection with the Online Store's operation are subject to EU law and the relevant national laws of the Consumer's country of residence.

Consumers can access the EU's Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr/

XI. FINAL PROVISIONS

These Terms and Conditions are effective from January 1, 2024.

Salag reserves the right to make changes to these Terms and Conditions for important reasons, such as:

  • Changes in applicable law
  • Changes in payment and delivery methods
  • Changes in the scope of services provided

Customers will be informed of any changes to the Terms and Conditions via email and through announcements on the website.

XII. ONLINE STORE REVIEWS

  1. Review Policy

1.1. Customers of the Online Store have the opportunity to voluntarily and free of charge submit reviews regarding purchases made in the Online Store. The review may also include an evaluation, photo, or review of the product purchased in the Online Store.

1.2. After purchases are made in the Online Store, the Seller provides the necessary data to create an email invitation to the company handling the survey process. Survey distribution and the process of collecting opinions in forms is fully handled by TrustMate SA, located at Bartoszowicka 3, 51-641 Wrocław, Poland. TrustMate SA sends an email message to the Customer requesting a review with a link to an online form enabling its submission - the online form allows answering the Seller's questions about purchases, rating them, adding their own description of the opinion, and photos of the purchased product.

1.3. Reviews can only be submitted by Customers who have made purchases in the Seller's Online Store.

1.4. Reviews submitted by Customers are published by the Seller in the Online Store and on the TrustMate.io profile.

1.5. Reviews must not be used by the Customer for unlawful activities, in particular activities constituting unfair competition against the Seller, or activities violating personal rights, intellectual property rights, or other rights of the Seller or third parties.

1.6. Reviews can only be submitted for products actually purchased in the Seller's Online Store. It is prohibited to enter into fictitious/apparent sales agreements to submit reviews. The author of the review cannot be the Seller or their employees, regardless of the basis of employment.

1.7. A submitted review can be removed at any time by its author.

XIII. TECHNICAL REQUIREMENTS

  1. To use the Online Store, the Customer must have:
  • A device with Internet access
  • An up-to-date web browser supporting HTML5 and CSS3
  • Cookies enabled in the web browser
  • An active email address

XIV. INTELLECTUAL PROPERTY

  1. All content, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Salag or its content suppliers and is protected by international copyright laws.
  2. The compilation of all content on this site is the exclusive property of Salag and is protected by EU and international copyright laws.

XV. FORCE MAJEURE

Neither party shall be liable for any failure or delay in performance of their obligations under these Terms and Conditions arising out of or caused by forces beyond its control, including but not limited to:

  • Natural disasters
  • Pandemics
  • Acts of war
  • Government actions
  • Network and telecommunications failures beyond our control
  • Power failures
  • Acts of terrorism

XVI. WEBSITE ACCESSIBILITY

Salag is committed to providing accessibility to its website for all users. We continually review and modify our practices to enhance website accessibility and user experience.

XVII. LIABILITY FOR NON-COMPLIANCE WITH THE AGREEMENT

  1. Basis of Liability

The basis and scope of Salag's liability towards the Consumer is governed by EU Directive 2019/771 on certain aspects concerning contracts for the sale of goods.

Salag is liable to the Consumer if the sold goods do not comply with the Sales Agreement. Salag is also liable for any non-compliance resulting from incorrect installation of the goods if the installation was carried out by Salag or under Salag's responsibility.

  1. Consumer Rights

In case of non-compliance of goods with the agreement, the Consumer may request:

  • Repair of the goods, or
  • Replacement of the goods

If bringing the goods into compliance with the agreement in the manner chosen by the Consumer is impossible or would incur disproportionate costs for Salag, Salag may:

  • Replace the goods when the Consumer requested repair, or
  • Repair the goods when the Consumer requested replacement

If repair and replacement are impossible or would incur disproportionate costs for Salag, Salag may refuse to bring the goods into compliance with the agreement, and the Consumer may request a price reduction or refund.

  1. Consumer's Liability for Reduction in Value

The Consumer shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

XVIII. PROVISIONS CONCERNING NON-CONSUMER CUSTOMERS

  1. Salag has the right to withdraw from the Sales Agreement concluded with a non-Consumer Customer within 14 calendar days from the date of its conclusion. Withdrawal from the Sales Agreement in this case may occur without giving a reason and does not give rise to any claims by the non-Consumer Customer against Salag.
  2. In the case of non-Consumer Customers, Salag has the right to limit the available payment methods, including requiring full or partial prepayment, regardless of the chosen payment method and the fact of concluding the Sales Agreement.
  3. Upon delivery of the goods by Salag to the courier company, the benefits and burdens associated with the goods and the risk of accidental loss or damage to the goods pass to the non-Consumer Customer. Salag is not liable in such case for loss, shortage, or damage to the goods arising from acceptance for transport until delivery to the non-Consumer Customer, or for delay in transport of the shipment.
  4. All goods delivered to the non-Consumer Customer remain the property of Salag until full payment of the price.
  5. In any case, the liability of Salag, its representatives or agents, in relation to a non-Consumer Customer, regardless of its legal basis, is limited to twice the value of the order.
  6. Any disputes arising between Salag and a non-Consumer Customer shall be submitted to the court having jurisdiction over Salag's registered office.
